This ordinance amends Accessory Dwelling Unit regulations providing additional opportunities for construction of Accessory Dwelling Units and legalization of unpermitted dwelling units while maintaining neighborhood compatibility.

This ordinance will provide for incremental increases in time that a person receiving a citation in a City park, beach or any other property maintained by the Parks and Recreation Department must stay away from the property where the arrest was made or citation issued.

Summary

*NOTE* The published public hearing notice for this ordinance included the incorrect vote block. The attached ordinance includes the correct vote block. This ordinance will amend sections of the Santa Cruz Municipal Code pertaining to the non-commercial use of streets and sidewalks, in particular, display device-aided street performance and speech activity. Currently City regulations designating where display device-aided street performance and speech activity is permitted in downtown Santa Cruz specify permissible locations in the context of distance requirements from storefronts, sidewalk cafes, intersections etc. This ordinance would replace those regulations and would provide that permissible display device performance and speech activity locations will be designated by sidewalk markings.

This ordinance will change the definition of reusable bags to those of thickness of 4 mils or greater, and will clarify current state plastic bag regulations.

Summary

This ordinance will require the following additional information on site plans: “Location of construction Best Management Practices (BMP’s) as required by the City’s mandatory Storm Water BMP manual, as published by the City Works Department.” This revision will enhance construction contractor awareness of the City’s construction BMP requirements to protect our local waterways.

Summary

This ordinance will create voluntary campaign expenditure limitations and mandatory contribution limitations for City Council candidates. It will create a uniform mandatory $350 maximum contribution limit (indexed at $50 increments at five year intervals) which will apply across the board to individuals, entities and organizational contributors such as political action committees and special interest groups.

This ordinance will add section 5.70 to the Santa Cruz Municipal Code that will establish a fee to support Public, Educational and Government (PEG) Channel Facilities pursuant to the Digital Infrastructure and Video Competition Act of 2006.

Summary

This ordinance will amend sections 6.04.040, 6.06.010, 6.06.020, 6.06.030, 6.07.010, 6.07.020, 6.07.030, 6.07.060 AND 6.07.140 of the Santa Cruz Municipal Code. The intent of the amendments is to eliminate the use of electronic cigarettes (e-cigarettes) in locations where smoking of tobacco and other related products are prohibited, to eliminate the sale of e-cigarettes to minors in order to reduce their use of these products, and to prohibit future tobacco and e-cigarette retailing near schools and high-risk alcohol outlets.

Summary

This ordinance will add Chapter 8.10 to the Santa Cruz Municipal Code that will enable animal regulation citations issued in the City of Santa Cruz to be handled administratively, by a hearing officer, with any resultant fees and penalties to be collected by the County Animal Shelter.

Summary

This ordinance will revise the Chapter 9.04 guest registry regulation to mirror the newly adopted Chapter 5.12 regulation by clarifying that a police officer can request the hotel/motel operator to voluntarily disclose registry information but that, absent a voluntary disclosure, the police department shall not have a right to review the registry information without a search warrant issued by a court.
