Summary

The ordinance amending Section 1.01.010 will simplify this outdated reference, and the new Section 1.01.035 will grant authority to the City’s current codifier, Code Publishing, Inc., to revise, index, reformat and republish the Municipal Code of Ordinances, and to make and publish future editorial amendments, technical corrections, revisions, reformats and supplements that do not affect the substantive meaning of the Municipal Code for the City.

Adoption of updated building codes of the City of Santa Cruz Municipal Code with the introduction of an ordinance amending building regulations contained in Title 18 of the Municipal Code and adopting the 2010 editions of the California Building Standards Codes, California Code of Regulations Title 24, Parts 1, 2, 2.5, 3, 4, 5, 8, 10, 11 and 12 including referenced appendices, amendments and modifications, as well as, the 1997 Uniform Administrative Code, 1997 Uniform Housing Code, the 1997 Uniform Code for the Abatement of Dangerous Buildings and supportive codes and standards as referenced therein.

The City’s camping ordinance currently requires the City Attorney to dismiss camping citations in the interest of justice if on the night the citation was issued the Armory homeless shelter which is operated during winter months was filled to capacity. This ordinance would require the City Attorney to additionally dismiss citations if on the night the citation was issued, the person who received the citation was currently on the waiting list for shelter service in the City provided by the Homeless Services Center, the River Street Shelter or a similar shelter service provider operating in the City.

Summary

If adopted by the City Council, this ordinance would require hotel and motel owners in the City of Santa Cruz to require their guests, when registering to stay at the hotel or motel, to verify their identification through production of a driver’s license, passport, government-issued identification or other acceptable proof of identification. Failure to do so would constitute an infraction. Use of false identification by a guest would also constitute an infraction. The ordinance would also require the hotel or motel operator to make the guest register available to City police officers for inspection upon request by a police officer.

This ordinance amendment allows dispensaries to operate on Sundays as long as the dispensary is located at least 50 feet from any residential use. The ordinance also added Section 24.10.1510-2m of the Municipal Code which was inadvertently deleted due to a numbering error.

This ordinance authorizes the City Attorney, in his or her discretion, to file criminal misdemeanor complaints for Municipal Code violations if the defendant has, on three or more occasions during any six-month period, failed to appear in court in connection with citations issued for a criminal violation of the Municipal Code or to post bail in connection with those citations. The City Attorney’s authority to file misdemeanor complaints would extend for one year from the date of the last such failure to appear.

This ordinance requires each medical marijuana provider association dispensary operating in the City to submit an annual report to document the dispensary’s compliance with the requirements of the State Law, the Attorney General’s Guidelines and the City Municipal Code.

Currently Chapter 2.40 requires all City boards and commissions to conduct regular meetings on a monthly basis. This ordinance will repeal this general monthly meeting requirement and instead provide that each board or commission shall conduct regular meetings per the schedule prescribed in that board or commission’s City Council-approved bylaws.
